Mediation
What is Mediation?
Mediation is a process for resolving disputes in which two or more parties voluntarily work together to resolve their differences with the assistance of an impartial third party. Mediation is useful in a wide array of conflicts, when emotions have eased enough that parties can communicate with each other and/or work together to reach a settlement.
What you can expect from me as your Mediator?
- An impartial 3rd party who will assist all parties to clearly communicate their needs, wants and concerns
- A professional who is obligated to maintain the highest level of confidentiality and protect privileged information
- Fair and respectful consideration for all parties involved
- Keep the discussion focused so that you can creatively resolve the conflict
- Facilitated discussion and assistance in the development of an agreement that is acceptable and fair to all. If appropriate, and with the consent of the parties, I may involve other people in the mediation as outside resources (accountants, lawyers, financial planners etc.) for specific information, or to co-mediate.
What are the Benefits of Mediation?
- Can be faster, less expensive and promote ongoing relationships
- Can empower people to make their own decisions and settle their own disputes
- Can end conflicts with dignity and fairness
- Will provide an example of how conflict resolution skills can help resolve conflicts
- Will provide confidentiality as it is a private process, unless you make it public
What kinds of conflicts can I mediate?
As long as both parties are willing to come together to discuss it, almost any conflict can be mediated with disputes relating to:
- Family members, marital relationships
- Co-workers, employer/employee
- Harassment & grievance issues
- Partnerships
- Business, consumer
Mediation is helpful, when?
- Parties are ready and motivated to resolve
- Parties understand the process and other options and believe that mediation is preferable to other methods
- The perceived power relationship is balanced
- Time and resources are realistic and sufficient and parties are willing to talk
- Those involved have the power to make a decision
- The issues are potentially resolvable through changes in behavior, practice or exchange of goods, services or money
What happens when issues are resolved?
- I will assist you in writing down your agreement.
- I do not give independent legal advice; you should consult your legal counsel, especially in matters relating to separation and divorce mediation.
- You can subsequently register this document with the courts.
What happens when the issues are not resolved?
- You can continue to live with the conflict

- Use any other process for resolving the dispute including litigation
